Terms of Service

1. What DearGivers is

DearGivers is a marketplace that connects families seeking care with independent caregivers. We are not a care agency, employer, or care provider ourselves. Caregivers listed on DearGivers are independent contractors, not employees of DearGivers, they set their own availability and rates, and are responsible for their own tax obligations.

2. Verification is a check, not a guarantee

We manually review the identity documents, police record, references, and certifications each caregiver submits. Verification badges reflect the status of those documents at the time they were reviewed. They are not a continuous, real-time guarantee of a caregiver's conduct, and DearGivers cannot guarantee the accuracy of documents issued by third parties (e.g. government agencies).

Families should still use their own judgement, including an initial meeting or call, before confirming any booking.

3. Limitation of liability

DearGivers is not liable for injury, loss, theft, property damage, or any other harm arising from a care engagement between a family and a caregiver. Families and caregivers engage with one another at their own risk, within the limits of what our verification process and platform tools can reasonably support.

4. Disputes and no-shows

If a caregiver does not show up for a confirmed, online-paid booking, DearGivers will attempt to find a same-day replacement or issue a refund, subject to our backup guarantee terms shown at checkout. For other disputes (quality of care, disagreements over hours worked, etc.), contact our support team with details, we will review evidence from both sides and make a determination, but DearGivers is not a court or regulator and cannot compel either party to act.

5. Cash payments

If you choose the option to pay DearGivers's booking fee online and settle with the caregiver directly in cash, DearGivers has no visibility into or responsibility for that cash transaction. Any dispute over the amount, timing, or completion of a cash payment is between the family and the caregiver, our backup guarantee does not apply to the cash portion of these bookings.

6. Your documents and data

Caregiver identity documents, police records, and reference information are visible only to the DearGivers verification team, not to families. We retain these documents only for as long as needed to keep a profile active and to comply with our own record-keeping obligations, and we will delete them on request once an account is closed, subject to any legal retention requirements.

7. Account removal

DearGivers may suspend or remove any account, family or caregiver, where we have a good-faith safety, fraud, or policy concern, without needing to establish wrongdoing to a legal standard. We'll aim to explain why wherever we reasonably can.

8. Independent contractor terms (caregivers)

By creating a caregiver profile, you confirm that you provide care services as an independent contractor: you control your own schedule, decide which requests to accept, set your listed rate (subject to platform fees), and are responsible for your own income tax and any required business registration. Nothing in these Terms creates an employment relationship with DearGivers.

9. Fees, payments, and refunds

DearGivers charges a service fee on top of a caregiver's rate for card payments, and a lower service fee for bank transfers, shown clearly before you pay. These fees fund verification, matching, payout processing, and platform support, and are non-refundable once a booking is confirmed and the job has taken place.

If a confirmed, online-paid booking is cancelled by DearGivers or by a caregiver before the job takes place, the family is entitled to a full refund of amounts paid to DearGivers. If a booking is cancelled by the family, the DearGivers service fee is non-refundable, refund eligibility for the remaining amount depends on how much notice was given, contact support for a case-by-case review. Bank transfer payments are only confirmed once DearGivers has verified receipt, which may take 1 to 3 business days.

10. Eligibility and account accuracy

You must be at least 18 years old and able to form a binding contract to create an account. You're responsible for keeping your account information (including contact details and, for caregivers, verification documents) accurate and up to date, and for anything that happens under your account as a result of you sharing your login credentials.

11. Acceptable use

You agree not to use DearGivers to harass, discriminate against, or endanger another user; to circumvent our verification, payment, or fee processes (for example, arranging an initial DearGivers booking and then moving future bookings off-platform to avoid fees); to submit false, forged, or someone else's identity documents; or to use the platform for any unlawful purpose.

Caregivers must also follow the Caregiver Code of Conduct, which forms part of these Terms and which each caregiver agrees to when they apply. Serious misconduct, as described in the Code of Conduct, may result in immediate removal from DearGivers.

Violating this section may result in suspension or permanent removal from DearGivers, in addition to any other remedies available to us.

12. Changes to these Terms

We may update these Terms from time to time as the platform evolves. We'll update the "Last updated" date below when we do, and for material changes we'll make a reasonable effort to notify active users. Continuing to use DearGivers after a change takes effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Jamaica. Any dispute that can't be resolved through our support team will be subject to the exclusive jurisdiction of the courts of Jamaica.

14. Contact us

Questions about these Terms can be sent to support@deargivers.com or via WhatsApp through the contact options in the app.
